My two friends were stopped by the police yesterday for making an illegal turn. While stopped, they had some marijuana in the car — just less than 30g. We live in [downtown] Chicago.
My one friend [the driver] was arrested and charged once before nearly 2 years ago for a disturbing the peace charge, but the charges were dropped.
My other friend [the passenger] was arrested and charged for a DUI at age 18 outside of the country nearly 4 years ago (does that count?). And over 3 years ago was charged with criminal mischief and trespassing (sounds bad, but she had an argument with her neighbor who blew the entire situation out of proportion). My friend was on probation for 5 months and did like, 50 or so hours of community service. This was also over 3 years ago.
I looked online and for Illinois it says that for 10-30g it is a misdemeanor with possible 1 year in jail/$2500 fine. Do you think they won’t have to serve jail time? It’s their first possession charge.

my husband went to Chicago (where our whole family lives) for 2 weeks for our family reunion. We live in Fl. and i did not go with him because i am in college and missing 2weeks would be terrible. My cell phone broke a couple days before he left and i couldnt get another one at the time because money is tight. we have no house phone and we do have a car. I asked him if i could keep his phone while he’s gone and he could take his sim card out and keep it with him. He told me NO because he wouldnnt have anything to use. He left me with no money either and he said he would send me a message on yahoo, myspace or facebook. i feel like he is wrong because he’s staying at family house and all of them have a cell and house phone. we have no family in Fl. (he in the Navy). What if i got really sick or something or the car broke down, which it does sound bad and the tire is messed up because he just got a DUI a few months back. IM i wrong for being mad???

I’ll keep it short: I acquired a job after I moved back to Iowa from Oregon, where I was layed off. I was hired but it took awhile for my background check to come back. I assumed they were just running my DAC, which makes me a little nervous because there is false information on it. *my father was judge for 23 years and he is still a practicing lawyer, for this I am grateful* as it will make suing these ******* alot easier. When my background check came back, it showed that I was a sex offender (not true), I had 7 felony convictions (I have zero felony convictions), and I have 2 theft convictions. None of this is true. There are 3 of ME (first, middle, and last name match) all over the country. I don’t know if they have mistaken me for one of the other guys, but I now have no job. And to boot, it was a great job. So: I spoke with my father, who is a retired judge and a lawyer, and he said: hang tight, just relax, we’ll get our man”. We may not get our man right away, but DAC services, now called “USIS” (I believe, or some variation on that), has screwed so many drivers that even though I’d like to settle my case on my own (and I may), we are thinking of undertaking a class action suit if the lawyer my father hires out of Chicago decides that there’s money to be made, so this is really a 2 part question. a: Has anyone else ever had trouble with DAC, and b: should it go class action, would you like to get on the list and get in on the action, not only money-wise (settlement), but also have your record cleared of false information? After the trade for Zack Randolph, the Clippers have one more really talented big man than the can use. Camby is a defensive beast and is averaging 9 and 9 with at least around 2 blocks a game in like 25 minutes. That’s great in that amount of minutes. Randolph has been averaging 20 plus and 12 a game which is beastly, and Kaman is a solid double double guy. To me, it seems like Kaman is the logical answer to be traded as he and Randolph kind of duplicate eachother. It’s been noted that the clippers really want to add a good wing player, I guess to back up Al Thornton. Bulls: Yes, they lose two good bench players who help their team a lot, but given their depth, this shouldn’t do them in. On the other hand, the upside is too great. They finally get the true center they need who also has a low post game. With Kaman going to work in the middle, it would open up the inside outside game with Gordon, Deng, Hughes, Hinrich (when he comes back), and even Rose, who is showing increased jumpshooting. He would also creat quite a dynamic duo with Rose, and a potential big 3 with Deng added. Projected lineup: Rose, Gordon, Deng, Gooden, Kaman, with Hinrich (again, when he comes back), Hughes, Thomas, Noah, and Gray. That team would become immediate challengers in the east.
Clippers: They clear up the space they need to have Camby and Randolph dominate on the inside, and get two very valuable pieces to help the team. Nocioni is a straight hustle guy, he’s going to give you 110% when he’s on the floor and would fit in great as a 6th man to come in for Thornton, Randolph, or even Camby (then Randolph can slide to the center spot). He is deadly from 3 point range, a good defender, and a guy who will immediately be a fan favorite. His numbers would also improve because he would definitely get more playing time than he is in the crowded Chicago frontcourt. Sefalosha is a player of the future. He is a lockdown defender, can play the 2 or 3 (even the 1 or the 4 in a pinch), and is still very young. He has also shown flashes of an offensive game and with time and consistant minutes could be very productive on that end of the floor as well. His stats really don’t do him justice as he does a lot of the intangibles and doesn’t get as many minutes as he deserves. Both Noch and Sefalosha fit the bill for the exact player the Clips are looking for: a good swing man. Noch has the offense and the intensity and Sefalosha has the defense and the potential (just look at his PER, it’s well above what most guys his age with his playing time are rated.)
All in all, I think this trade would really benefit both teams. What do you think?

I have an 18 year old daughter in another state who just got a DUI and I’m trying to advise her on what to do. One piece of advice is to attend AA meetings even in advance of her first court date and I believe there is a form you can take to those meetings and have them signed to demonstrate that you attended.
Can one just make this form up from scratch and if so, what are the key fields one should include to fill in (e.g. location, time, name of meeting, leader’s name, any phone numbers, etc.?)
Or must this come from some official source like DUI court or a psychologist, a social worker, an officially supported alcohol awareness program, etc.?
We can’t afford a full-priced attorney so a Public Defender may be needed. I know there may be other low-cost legal defenders out there through Public Aid, but I’m not sure how to find them. Any advice you have will be appreciated. This would be in DuPage County, Illinois — a Western Suburb of Chicago.

Plus, I have no family to visit. It’s so depressing. I used to love Christmas. We live in Michigan and have a big yard with lots of pines and it’s snowing right now and looks so Christmasy but I still am depressed. I got a DUI several weeks ago and had to spend all my money on a lawyer and bond but I guess that’s my own fault. I was planning on going to New York City with my Mom before that happened. We do live near Chicago and it’s fun to go and look at the decorations there but I won’t be able to buy any presents! I think I should volunteer somewhere during the season like to help with poor families. My Mom offered to get tickets to the Nutcracker ballet in Chicago but I’m not even in the mood for that. I know you are thinking “Quit bitching and feeling sorry for yourself, there are people way worse off than you” and you are right but I still can’t help being sad. We’re not even putting up a tree! Should I force myself to go out and atleast put some lights on our house?

What began earlier this year as one young man’s quest to stay in the U.S. has grown into a movement, with nearly 200 demonstrators rallying on behalf of Rigo Padilla in Chicago last week and faxes and text messages being sent to Washington with pleas to spare him from being sent back to Mexico.
Padilla, 21, hasn’t seen the country of his birth since he was 6 — making him one of thousands of young undocumented immigrants who arrived to the U.S. illegally as tag-alongs to their parents.
His fight against an order to leave the country by Dec. 16 has made him a symbol to Immigration activists yearning for passage of the DREAM Act, proposed legislation that would grant conditional legal status to undocumented students who arrived to the U.S. as children.
At the same time, the fact that Padilla’s illegal status was discovered when he was arrested in March for drinking and driving has energized groups opposed to legalization of the undocumented. Some conservative bloggers have characterized Padilla as a criminal who deserves to be booted out of the country. An initial felony charge later was reduced to a misdemeanor DUI, to which Padilla pleaded guilty.
With supporters chanting his name Friday inside the First Methodist Church, Padilla appeared choked up by the attention, clearing his throat several times before he could say “Thank you.”
He recounted a life in Chicago that began in 1994, when he arrived with his family from the Mexican state of Jalisco and was placed in a bilingual education class.
Four years later, he said, he’d finally learned enough English to enroll in a regular fifth-grade class.
“At the time, it was the biggest moment in my life,” he said. “I remember wanting more. I remember working extra hard and being told that, if I worked hard enough, I could accomplish anything.”
Referring to his DUI arrest, he added, “Unfortunately, I did make one mistake that I am very sorry for.”
Padilla is enrolled at the University of Illinois at Chicago with a major in Latin American and Latino studies with a minor in sociology. He has been an active student leader there, attending classes while wearing the ankle monitor he was issued by federal Immigration authorities in lieu of being detained.
“He’s one of the top students of my class,” said Nilda Flores-Gonzalez, a UIC sociology professor who has helped coordinate an online petition drive of university faculty that has spread to other parts of the country. “It would be our loss if Rigo is deported, as we would lose one of our finest.”
Padilla’s story inspired the Chicago City Council last month to pass a resolution on his behalf calling for his deportation to be stayed.
Since then, several more legislators and religious leaders have joined the campaign to “Stop The Deportation of Rigo Padilla” a movement driven by students and the Illinois Coalition for Immigrant and Refugee Rights.
On Friday, U.S. Rep. Jan Schakowsky, D-Ill., announced that she has introduced legislation that would specifically benefit Padilla and seeks to grant him legal permanent residency.
Though the bill doesn’t guarantee relief for Padilla, it could delay the process, Schakowsky said, calling on Congress to speed efforts to again consider Immigration reforms that could resolve cases like Padilla’s.
Officials at U.S. Immigration and Customs Enforcement said the process for Padilla will continue according to schedule.
“Rigoberto Padilla is in the United States in violation of federal Immigration laws and has been duly afforded due process through Immigration courts,” Gail Montenegro, the Chicago spokeswoman for ICE, said in an e-mailed statement.
With his deadline looming, Padilla sought to keep a cool attitude, smiling at supporters and politely answering reporters’ questions, sometimes in rusty Spanish.
“All my family is here; I don’t know anyone in Mexico,” he said. “I’m trying to balance my time and have enough energy to go to school. That’s why I’m here; that’s why I came to this country.”
Meanwhile, the campaign on his behalf flickered with intensity.
“You don’t deport our best resources when we’re trying to fix the Immigration system,” the Rev. Michael Shanahan, pastor of Our Lady of Lourdes Catholic Church, said at the rally. “If nothing happens to stop the deportation of Rigo Padilla … we will be back and we are ready to be arrested, including myself.”

I mean we are supposed to be a leading nation. Look at us now. Medical care is CRAP. God damn president vetoed child health care. New Orleans still suffer from the hurricane. California now suffers from “sinking” streets. The Utah miners’ crisis still exist. Iraq. Iran. Afghanistan. The Middle East. Wages and salaries problems. Chicago school teachers suffering. Black and white kids in court for racist felonies. Violence. Rape in Harlem, killing in Brooklyn, and false DUI arrests. Our celebrities are nothing but scandals. The whole world observes us. People all over the world hate us now. The whole administration just sucks! Candidates are very dramatic and fake about their speeches and promises. I mean it is not safe now. Hired a lawyer,the charges were dismissed by the court and prosecutor.Dui and a small felony, anyway after court i was expecting to sign or receive some paper proof from the court (chicago).Is this the new age of court procedure? Additionally how long will the paperwork take to go through to the state capitol? I don’t know how to feel about this.All i have is my attorneys name and the judges.I did check the docket where my name was listed.

A veteran DuPage County prosecutor was driving drunk with a blood-alcohol level three times the legal limit when she died in a May 11 car crash, authorities said Friday.
Jane Radostits died after the 3:45 p.m. head-on crash near Winfield that occurred when her county-issued Chevrolet Impala collided with a Chevy Tahoe SUV, officials have said. Two other vehicles also were damaged in the collision, which happened on a four-lane stretch of Winfield Road and seriously injured a West Chicago woman driving the Tahoe.

Too many lawyers live to blunt or prevent true justice. No pity from me to those who choose a career of half-truths, wherein success depends on what the meaning of “is” is.
I’ve always thought it interesting that DUI is probably the only crime where at least 10 of the jurors have been guilty of it themselves.
Almost everybody has at some point in their life driven when over the legal limit.

My sisters has an abusive (as of recently) ex-boyfriend that was taken to jail for slapping her on Friday morning.
Here are the circumstances:
they have 2 children together and in December ‘08 he hit her in front of the children and kicked her out of the car in the middle of nowhere in Indiana (they live in Chicago). She flagged down a police officer and they pressed charges. They the stupid girl signed a letter that he wrote for her saying that she was mad and that is why she said that he left her to the state prosecutors office, so they gave her a restraining order that she can live with me and be in the same room but he can’t abuse her, drink, or anything else that is potentially harmful. He violated this in Chicago on Friday morning when he smacked her in the face. The case in Indiana is a felony case because it was in the presents of minors. She wants him to go and rot in jail, but is worried that he may get bonded out. To me, it sounds like he would either get a really high bond or no bond at all. He has 2 DUI’s here in Chicago and has been arrest numerous other times, but the charges (other than the DUI’s) have all been dropped.
What do you think?

Atlanta, New Orleans, and Chicago. Why do I say this? Because, here in my hometown of Atlanta, Georgia, housing projects have been AND STILL ARE being torn down (as well as other low-income housing areas where the majority of the residents were and still are Black) and condos and expensive apartments are being built. In Atlanta, the newly built condos and expensive apartments are being lived in by White people who are from out of state and accustomed to paying high rent and leasing prices. About 4 years ago, I was in a car accident and was charged with a DUI in Chicago, IL. I paid my fines to the court and received my driver’s license back. From then I relocated out of state due to a job offer. As I went to the DMV to change my licensse over to a Georgia state license I was told that I would have to contact the DMV in IL to find out why my license was taken away. I called and they informed me that the other person involved in the car accident filed a judgement against me on my driver’s license. I told to file bankruptcy and that would take care of the judgement on my license and I would be able to get it back. Is that true ? Does anyone have any advice ?

This has been rumored to be the frontrunning trade for Amare Stoudamire. It seems to make sense for both teams. Tyrus Thomas is really coming on strong now, and could thrive with a pg like Steve Nash. Sefalosha has shown flashes of being a great role player if given the minutes, and Gooden’s contract expires this year. The Suns get everything they want, and for the Bulls it’s a no brainer.

Tyson Chandler has also been rumored to be on the block. This trade would be accepted for sure by the Hornets. They get a very competent and young replacement for Chandler in Noah, and a huge upgrade at the shooting guard spot, as Gordon would be an excellent complement to Paul. Since Gordon would get a guarenteed starting spot, he would accept this trade as well (early bird option allows him to block a trade). Also, New Orleans gets rid of Chandler’s big contract while gaining 2 expiring contracts. The Bulls give up a lot, but get a perfect complement at the center spot to Stoudamire. Washington has been interested in acquiring Hughes since before the season started, and apparently the talks have re-opened lately. In return for Hughes, the Wizards give up two overpaid, oft-injured players in Thomas and Stevenson, and two young players who don’t get any playing time and aren’t really in the teams future plans: McGee barely gets playing time now, with Blatche and Haywood out. So, when Blatche comes back, he and Pecherov will share the minutes until Haywood’s return when even Pecherov will barely play. Crittenton will never see much playing time as when Arenus returns, it will be Arenus, James, and Dixon, leaving little to no time for Crittenton to play.
The Bulls would be a completely made over team and a new starting lineup would look like this: Rose, Hinrich, Deng, Stoudamire, Chandler. Then they would have Crittenton, Stevenson, Nocioni, Mcgee, and Gray coming off the bench…. That would be a starting five aged 20, 27, 23, 26, and 26. That is a young and promising starting 5 with an even younger bench of (early 20’s), 27, 29, 21, and 22ish. They would be contenders for years to come with that lineup, but do still have some cap space coming in 2010 when Thomas’ and Stevenson’s contracts come off the books.

My husband and I are planning a road trip from Dallas to Chicago this December. We are planning to leave the day after Christmas and return on the 30th. I know it normally takes about 15 hours, but I wasn’t sure if we should expect it to take longer with winter road conditions? Should we get chains for our tires? I need my file and remaining money in attorney’s client trust account that belong to me.
1. What should I include in my letter to fire attorney?
2. Should I tell him why I am firing him?
If he doesn’t send my file and I hire a new attorney to get the file and money, can ex-attorney be realiable for the cost (fee)
because he did not send file by the dateline?

I have a friend who is being wrongly accused of something he hasn’t done, and is currently incarcerated behind it. The court appointted attorney that he has, does not have his best interest in mind. The attorney met with my friend once in the last 3 or 4 months and when my friend’s family inquire about the case the attorney gives them the run around. My friend and his family can’t afford an attorney, so they have pretty much given up hope of him ever coming home. So if there is anyone who knows anyone willing to help my friend, please let me know. Any info or help would be grately appreciated.

I am working on a property that is in foreclosure in WA state. It is 2 months into the process, $11,500 in back payments and taxes and a few thousand in attorney fees for the mortgage holder’s attorneys. Is there a ballpark estimate of how much attorney fees will be once the 135 days is up and it goes to sale, and is there any formula for calculating the rate of their charges?

I asked this question in a different way, and I neglected to explain that it’s not a law suit case, so ‘contingency’ is probably not an option.
My question is: If a potential client doesn’t have the entire retainers fee up front for an attorney, is there a way that an attorney can start representing the client with some sort of a guarantee that he/she will be paid? Is there a form of written agreement that can be drawn up between the attorney and the potential client?
